A
Njoro farmer who indecently assaulted and infected his daughter with HIV has
been sentenced to 75 years in jail.
The
man was found guilty of indecently touching and deliberately transmitting HIV
to his 12-year-old daughter on January 12, 2013 in his Njoro home.
The
court ruled that the suspect will serve 25 years for indecently assaulting the
girl and 50 years for deliberately infecting her with HIV.
Senior
resident magistrate Judicaster Nthuku said the beastly act has changed the
girl's life.
The
suspect was initially charged with incest, indecent act with a child and
deliberate transmission of HIV.
The
clinical officer who tested him and his daughter found there was no
penetration.
“When
I did the examinations, the accused tested HIV positive. The minor's private
parts had bruises, though the hymen was intact,” said the clinical officer.
The
court heard that on that day, the man came home drunk and found the girl and
her three siblings sleeping.
He
asked her to join him in a separate room. The girl obeyed oblivious of the
danger.
The
standard five pupil testified that her father moved to the separate room and
warned her not to scream.
He
then performed the indecent act.
