NAIROBI,
Kenya, Apr 14 – Nairobi Senator Mike Sonko on Tuesday moved to court to
challenge the decision by Nairobi Governor Evans Kidero to partially block
three major roundabouts in Nairobi.
In
an urgent application, Sonko argued that closure of parts of the Lusaka,
Bunyala and Westlands roundabouts had affected flow of traffic on Uhuru
Highway, Bunyala and Langata Roads.
He
asked the court to prohibit the county government from re-configuring the three
roundabouts and order for their restoration.
He
said the decision taken by Kidero was also illegal and in contradiction of the
Constitution.
“The
action by the respondents is unlawful by altering the structure of the affected
roads without the necessary roads engineering structural maps necessary to
execute such a task is unconstitutional, “Sonko complained.
According
to Sonko, Kidero and the Transport Ministry did not give Kenyans alternative
routes to use when they agreed to block sections of the three roundabouts.
In
instances where roads are blocked, he explained, users are given alternative
routes to use to ensure the inconveniences are taken care of.
The
case at the High Court is scheduled for hearing on Thursday.
Sonko
was ordered to serve Nairobi County, Transport Cabinet Secretary, Kenya
National Highway, Kenya Roads Board, Kenya Urban Roads Authority and the
Attorney General who are respondents in the case.
Meanwhile,
Lusaka and Bunyala roundabouts were on Tuesday temporarily re-opened until the
Southern by pass is completed in the next three days according to Kidero’s
office.
